1. GENERAL INFORMATION
18-year-old Brazilian citizens, or foreign citizens bearing a valid RNE - Register of Foreign National/Registro Nacional de Estrangeiro card, in order to appoint a legal representative in Brazil, must do it by means of a power of attorney.
The powers of attorney may be:
- through public instrument: the power of attorney is prepared at the Consulate, according to a draft text that must be brought by the applicant. The applicant must come in person to the Consulate bearing a valid Brazilian identification document for signature. The draft text may be submitted in advance by e-mail in order to reduce the processing time (info@consbrastoronto.org).
- through private instrument: the text is prepared by the applicant who must, notwithstanding, come in person to the Consulate, bearing a valid Brazilian document, for the authentication of his/her signature.
REQUIREMENTS
Documents
- Valid Brazilian identification document (identity card, RNE – Register of Foreign National or passport);
- Text with accurate and concise description of the powers to be granted; and
- Inform the following data about the granter (the one who delegates powers) and the grantee (the one who will be granted the powers):
- Full name (no initials or abbreviations, including the middle names);
- citizenship;
- civil status;
- profession;
- address;
- identity card (number, date and location of issuance); and
- CPF (Fiscal Card) number.
Form
- Fill out the form power of attorney request.
Fee
- The fee for public or private powers of attorney is Cnd $25.00, which must be paid through “money order” or “certified cheque” to the “Consulate General of Brazil in Toronto”. Cash, personal cheques, debit or credit cards will not be accepted.
- If the applicant cannot come in person to the Consulate, the power of attorney must be signed before a notary public. The signature of the notary public, in its turn, must be certified by the competent provincial government institution, and then sent to the Consulate for legalization.
2. PROCESSING TIME
- The processing time for a power of attorney is 05 working days. The delivery of processed powers of attorney has to be done before 1 PM.
3. MAIL SERVICE
Powers of attorney may be legalized by mail. A pre-paid and self-addressed Canada Post envelope (registered mail, xpresspost ou priority courier) must then be sent for return. The Consulate apologizes for the inconvenience, but only Canada Post envelopes are accepted. The Consulate will not be held responsible for any lost, delayed or stolen documents.
